Rules for using Hoops DJ.

Acceptance of terms

By using Hoops DJ, a service operated by Sienna Logic LLC, you agree to these Terms of Service and our Privacy Policy.

Who can use Hoops DJ

You must be at least 18 years old, or the age of majority where you live, to create an account. You are responsible for activity that occurs under your account.

Objectionable content and reporting

We have no tolerance for objectionable content or abusive users. To report objectionable content, abusive behavior, or player information entered without permission, email [email protected]. We may remove the content or terminate the account responsible.

Teams

Your account and subscription cover the teams you personally coach or help run. They do not cover setting up teams for other coaches or across a league, club, or school. For that, contact us at [email protected].

Your content

You keep ownership of what you put in Hoops DJ, and you are responsible for it, including music you import and player and coach information. You are responsible for making sure your use of music and other media follows the applicable licenses and terms. Hoops DJ does not give you rights to any music or other media. By entering a player's name or other details, you confirm that you have the authority to do so and, for a minor, the permission of a parent or guardian.

You grant us a non-exclusive, royalty-free license to host, store, process, and display your content, and to send it to the service providers that run the features you use, so we can operate Hoops DJ. This license ends when you delete the content or your account, except for copies that remain in backups or storage.

Plans and subscriptions

The Starter Plan has limits on how many teams and players you can use. Season Pass is a paid plan that unlocks more. Prices and billing terms are shown in the app before you buy. Season Pass is billed through the App Store or Google Play. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period in your store account settings. Refunds are handled by Apple or Google under their policies, and payments are otherwise non-refundable. If your Season Pass ends, you return to the Starter Plan, and teams or players over its limits may be locked until you buy Season Pass again.

A new account may start with a Season Pass Preview, which unlocks Season Pass features for a limited time at no charge. When it ends, you return to the Starter Plan unless you buy Season Pass. The preview and promotional offers are limited to one per person unless stated otherwise. We may change prices, plans, plan limits, the preview, and offers.

Suspension and termination

We may suspend or terminate an account, along with the teams it owns, or limit features such as announcement generation, if you break these terms or if we believe the account is being used abusively, to get around plan limits or payment, or in a way that could harm Hoops DJ, its users, or others. You can stop using Hoops DJ or delete your account at any time. Termination does not entitle you to a refund, and cancelling a store subscription is your responsibility.

Disclaimer and limitation of liability

Hoops DJ is provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We may change, suspend, or discontinue any part of Hoops DJ at any time, and we do not guarantee that Hoops DJ, or the third-party services it uses, will always be available or error-free.

To the fullest extent permitted by law, Sienna Logic LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of Hoops DJ. Our total liability for any claim relating to Hoops DJ is limited to the greater of the amount you paid for Hoops DJ in the 12 months before the claim or $50.

Indemnification

You agree to indemnify and hold harmless Sienna Logic LLC and its owners from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your content, your use of music or other media through Hoops DJ, or your violation of these terms or anyone's rights.

Changes to these terms

We may update these terms. When we do, we will post the new version here and change the date above. Continuing to use Hoops DJ after that means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute relating to Hoops DJ must be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

General terms

If any part of these terms is found unenforceable, the rest still applies. Our failure to enforce a provision is not a waiver of it. We may transfer these terms as part of a sale or transfer of our business. The sections on your content, disclaimer and limitation of liability, indemnification, and governing law continue to apply after your account ends.
